Introduction

Welcome to GO GAS (“Company”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) govern your access to and use of the services, products, communication platforms, APIs, websites, applications, and related solutions operated by GO GAS, having its registered address at Confidence Tower, 34 Central Bazar Road, Ramdaspeth, Nagpur, Maharashtra, India – 440012.

GO GAS provides communication-enabled services including, but not limited to, WhatsApp Business API solutions, Rich Communication Services (RCS), customer engagement tools, notification systems, messaging automation, support integrations, and related digital communication services for businesses and customers.

By accessing, browsing, registering for, or using any service provided by GO GAS, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms in accordance with applicable laws of India.

If you do not agree with these Terms, you must discontinue use of the services immediately.

Definitions

For the purpose of these Terms:

  • “Services” refers to all products, messaging platforms, APIs, dashboards, software, integrations, websites, and communication solutions provided by GO GAS.
  • “User”, “Client”, “Customer”, or “You” refers to any person, business entity, organization, or representative accessing or using the services.
  • “WhatsApp Business API” refers to Meta-authorized communication infrastructure enabling business messaging through WhatsApp.
  • “RCS” means Rich Communication Services provided through telecom operators, Google infrastructure, or associated communication partners.
  • “Platform” refers to the website, portal, dashboard, application, API system, or communication interface managed by GO GAS.
  • “Message Content” includes text, images, videos, templates, documents, links, campaigns, and other materials transmitted through the services.
  • “Applicable Laws” refers to laws, regulations, rules, guidelines, and governmental directives enforceable in India.

Acceptance of Terms

By using GO GAS services, you confirm that:

  1. You are legally capable of entering into a binding agreement under Indian law.
  2. You are authorized to act on behalf of the business or organization using the services.
  3. You agree to comply with all applicable laws, Meta policies, telecom regulations, anti-spam rules, and communication compliance requirements.
  4. You accept these Terms in full without limitation or modification.

Continued use of the services constitutes ongoing acceptance of the latest version of these Terms.

Description of Services

GO GAS provides communication and engagement services that may include:

  • WhatsApp Official Business API integration
  • RCS messaging services
  • Business communication management
  • Customer engagement automation
  • OTP and transactional messaging
  • Promotional campaign delivery
  • Customer support messaging
  • Analytics and reporting tools
  • Messaging template management
  • Cloud-based communication infrastructure
  • API integration and support services

GO GAS reserves the right to modify, suspend, improve, or discontinue any service without prior notice where required for operational, legal, or compliance reasons.

Eligibility

To use the services offered by GO GAS:

  • You must be at least 18 years of age.
  • Businesses must possess lawful authority to operate.
  • Users must provide accurate registration information.
  • Users must not be prohibited under Indian law or international sanctions from using communication services.

GO GAS reserves the right to reject, suspend, or terminate accounts that fail to meet eligibility requirements.

Account Registration

Users may be required to create an account to access certain services.

By registering, you agree to:

  • Provide accurate and updated information
  • Maintain confidentiality of login credentials
  • Accept responsibility for activities conducted through your account
  • Notify GO GAS immediately regarding unauthorized access or security breaches

GO GAS may verify business identity, documents, and compliance information before activation of services.

Failure to provide accurate information may result in suspension or termination.

User Responsibilities

Users of GO GAS services agree:

  • Not to use the platform for unlawful, fraudulent, misleading, or abusive purposes
  • Not to send spam, unauthorized promotions, or deceptive communications
  • To obtain proper user consent before sending messages
  • To comply with Meta Business Messaging Policies and telecom regulations
  • Not to transmit malware, harmful code, or prohibited content
  • To maintain confidentiality of customer information
  • To ensure message content complies with applicable advertising and consumer laws

Users are solely responsible for content transmitted using GO GAS services.

Payment & Billing Terms

Certain services offered by GO GAS are chargeable.

Users agree that:

  • All fees must be paid as per agreed pricing plans
  • Charges may include platform fees, API charges, telecom charges, and taxes
  • Applicable GST and government taxes shall be payable additionally
  • Delayed payments may result in suspension of services
  • GO GAS may revise pricing with prior notice
  • Payments once processed may be non-refundable unless otherwise agreed in writing

Invoices shall be generated electronically and delivered through registered communication channels.

Subscription Renewal & Termination

Subscriptions may renew automatically unless cancelled before the renewal date.

GO GAS reserves the right to suspend or terminate services if:

  • Payments remain overdue
  • The user violates these Terms
  • Regulatory or compliance issues arise
  • Meta or telecom partners require suspension
  • Fraudulent or suspicious activity is detected

Users may request account termination by contacting the official support team.

Upon termination:

  • Access to services may cease immediately
  • Pending dues remain payable
  • Certain records may be retained for legal and compliance purposes

Use of WhatsApp Official API & RCS

GO GAS provides messaging infrastructure subject to third-party platform policies.

Users acknowledge and agree that:

  • WhatsApp messaging is governed by Meta policies and terms
  • RCS messaging may be governed by telecom operators and Google standards
  • Message templates may require approval from Meta or telecom partners
  • Messaging without valid customer consent is prohibited
  • GO GAS cannot guarantee uninterrupted approval or delivery by third-party providers

Users shall remain fully responsible for:

  • Opt-in collection
  • Customer consent management
  • Message content compliance
  • Campaign legitimacy
  • Data processing legality

Violation of Meta or RCS policies may result in account restrictions or permanent suspension.

Message Delivery & Compliance Policy

GO GAS does not guarantee:

  • Instant message delivery
  • Continuous uptime
  • Delivery success to all recipients
  • Platform availability controlled by third parties

Message delivery may depend on:

  • Telecom operators
  • Internet availability
  • Device compatibility
  • Meta infrastructure
  • User permissions and opt-in status

Users agree not to use services for:

  • Spam campaigns
  • Illegal advertisements
  • Adult content
  • Gambling promotions
  • Financial fraud
  • Misleading claims
  • Hate speech
  • Harassment or abusive content

GO GAS may monitor usage patterns for security and compliance purposes.

Intellectual Property Rights

All intellectual property related to GO GAS services including:

  • Software
  • Branding
  • Logos
  • Dashboards
  • APIs
  • Designs
  • Documentation
  • Content
  • Trademarks

shall remain the exclusive property of GO GAS or its licensors.

Users receive a limited, non-exclusive, revocable license to use the services strictly for lawful business purposes.

Users may not:

  • Copy or redistribute proprietary materials
  • Reverse engineer systems
  • Modify platform code
  • Create derivative works
  • Use branding without authorization

Confidentiality

Both parties agree to maintain confidentiality regarding:

  • Business information
  • Customer data
  • Pricing
  • Technical integrations
  • API credentials
  • Proprietary information

Confidential information shall not be disclosed to unauthorized third parties except:

  • With written consent
  • When required by law
  • To authorized service providers under confidentiality obligations

These confidentiality obligations survive termination of the relationship.

Disclaimer of Warranties

GO GAS services are provided on an “as-is” and “as-available” basis.

To the maximum extent permitted under law, GO GAS disclaims:

  • Warranties of uninterrupted service
  • Guarantees of delivery performance
  • Accuracy of third-party systems
  • Compatibility with all devices or networks
  • Error-free operations

Users acknowledge that communication platforms depend on third-party infrastructure beyond GO GAS control.

Limitation of Liability

To the fullest extent permitted by law:

GO GAS shall not be liable for:

  • Indirect damages
  • Consequential losses
  • Data loss
  • Revenue loss
  • Business interruption
  • Reputation damage
  • Messaging failures caused by third-party providers

Total liability arising under these Terms shall not exceed the amount paid by the user to GO GAS during the preceding three months of service usage.

Indemnification

Users agree to indemnify and hold harmless GO GAS, its directors, employees, partners, and affiliates against claims, losses, liabilities, penalties, or expenses arising from:

  • Violation of these Terms
  • Illegal messaging activities
  • Spam complaints
  • Breach of customer consent obligations
  • Intellectual property infringement
  • Regulatory non-compliance

This indemnity obligation survives termination of services.

Governing Law (India)

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising out of or relating to these Terms shall fall under the exclusive jurisdiction of the competent courts located in Nagpur, Maharashtra.

Users agree to attempt amicable resolution before initiating formal legal proceedings.

Changes to Terms

GO GAS reserves the right to modify these Terms at any time.

Updated Terms may be published on official communication channels or websites.

Continued use of services after updates constitutes acceptance of revised Terms.

Users are encouraged to review the Terms periodically.
